Supreme Court upholds Left Coast
« on: January 10, 2005, 05:32:59 PM »
The US Supreme Court upheld a decision by the 9th Circuit, the most reversed federal appeals court in the country, reversing dismissal of a lawsuit against the manufacturer of guns that were used in a murder.

One of the guns in question was originally sold by the defendants to a police dept., which sold it to a dealer, which sold it to a collector legally entitled to own the gun, who sold it to a convicted felon. So, they are trying to hold the manufactuer, distributor, and dealer liable for something that happened at least 4 transfers after it left their control. Essentially, the plaintiffs are saying that it is negligent to sell guns to the police!

If there was ever a case for application of Fed. R. Civ. P. 11, (awarding attorney fees for defending against frivolous filings) this is it.
Gentleness can only be expected from the strong.  Ancient Chinese proverb.
